MDU claims over Irish jurisdiction again rejected


The latest development in long running legal battles arising from the Medical Defence Union's refusal to provide indemnity cover for Irish based consultants has seen the High Court again reject the MDU's claim that the Irish courts do not have jurisdiction to decide whether or not it was entitled to refuse cover. Mr Justice McKechnie also refused to refer the matter to the European courts.

In 2008 the European Court of Justice determined that it was for the Irish courts to decide if the MDU was entitled to refuse to indemnity consultants involved in medical negligence actions. The MDU wishes to have the matter determined by the UK courts, where it is incorporated.
