HSE Pharmacy Dispute
David Phelan acted successfully on behalf of the Hickeys Pharmacy Group in the recent High Court case taken by that pharmacy group against the HSE in the Commercial Court. The Court found that the HSE was in breach of its contractual obligations to the Hickeys Pharmacy Group in the way in which it had unilaterally altered the basis upon which pharmacists are reimbursed for prescription medications issued through the medical card scheme, and related schemes. The case had direct relevance for all pharmacies in the country which dispense prescription products on foot of the medical card scheme. The case also involved the competition law aspects of negotiation of the standard pharmaceutical contract in the area.
